Bank Holiday and Closure Day Rates

This information should be read in conjunction with the Leicester Manual and Ancillary Agreement in order to understand the full set of terms and conditions.

The rate of pay for bank holiday working is:

Double time, plus time off in lieu for each hour worked.  For clarity the term double time means that for each hour an individual works, they will receive payment at 2 x plain time.  This payment includes any hours the individual is contracted to work on that day.

The rate of pay for closure day working is:

Time and one half, plus time off in lieu for each hour worked.  For clarity the term time and one half means that for each hour an individual works, they will receive payment at 1.5 x plain time.  This payment includes any hours the individual is contracted to work on that day.

In addition to this, Line Managers will be able to offer their team members the option to receive payment (at plain time) instead of time off in lieu, should the needs of the business allow.

Where an individual’s shift spans over two days, the premium rate of pay will be applicable for the duration of the shift that commenced on the calendar date that the bank holiday/closure day fell.

Easter Sunday is not a statutory holiday and will not attract the above premium rates of pay; the appropriate rates of pay as detailed in the Leicester Manual and Ancillary Agreement will be applied.


Employee A is contracted to work 7 hours per day, Monday to Friday.
They work 4 hours on a bank holiday, and receive payment as below:
Contracted pay   4 hours at plain time
Additional Pay   4 hours at plain time
Time of in Lieu   4 hours at plain time
Therefore they receive 4 hours double time, and 4 hours as time off in lieu to take at a mutually agreeable time.


Employee B is contracted to work 5 hours per day Wednesday to Saturday.
They work 4 hours on a bank holiday Monday, and receive payment as below:
Contracted pay   None, as this is an additional shift
Additional Pay   4 hours at double time
Time of in Lieu   4 hours at plain time
Therefore they receive 4 hours double time, and 4 hours as time off in lieu to take at a mutually agreeable time.

Notes

  • These are the rates of pay to be paid on these days.
  • These rates override any other rates of pay, including premium overtime rates.
  • These rates are paid irrespective of the number of hours the individual works in their normal working week.
  • There is no requirement to have, or plan, to work in excess of 35/37 hours before these rates apply.
