Evaluation of a novel alternative dispute resolution scheme

Masood Ahmed

The Scheme incorporates adjudication, an ADR method traditionally used in construction disputes, to resolve professional negligence claims. The aim of the Scheme is to minimise the costs and costs exposure of those who wish to being professional negligence claims. The Scheme has been approved by Mr Justice Ramsey of the High Court and has been devised by the Professional Negligence Lawyers Association, the Association of British Insurers and the Professional Negligence Bar Association. Masood will be responsible for collating and analysing feedback from those who will participate in the Scheme and his findings will be reported to senior members of the judiciary, the Ministry of Justice and the Civil Procedure Rule Committee.
