Copyright and Scanning under the CLA Licence

You may wish to distribute material to your students electronically using Blackboard. If you are considering scanning materials, please read the information below, and consider the Digitising book and journal extracts page.

The University's Copyright Licensing Agency (CLA) licence now allows the scanning of some copyright protected material for teaching purposes for registered University of Leicester students, including distance learners. Inclusion of material not covered by licences must be with the permission of the rights holder.

Important Deadlines 

The deadlines for submitting your Document Request Form each year are as follows:

Semester 1

End of July

Semester 2

End of November 

We will still accept requests after these dates but cannot ensure they will be available by the start of the relevant semester.

What materials can I scan?

Tick The CLA licence allows scanning of limited extracts from copyright protected printed books, journals and magazines. The copies must be made from an original of a book, journal or magazine owned by the University.

  • Up to 5% or one chapter of a book
  • Up to 5% or one article from a single issue of a journal
  • Up to 5% or one paper of one set of conference proceedings
  • Up to 5% of an anthology or one short story or one poem of not more than 10 pages
  • up to 5% or one case of one report of judicial proceedings

The material can be text only, text and image or an image disembedded from the text.

You can scan materials that are published in the UK provided that they are not on the CLA excluded UK publishers list. For materials published outside the UK check the CLA's International Territories list.

If the Library provides an electronic version of a chapter or article you can certainly link to the electronic version.

Are there any licence requirements with regard to scanned items?

  • These materials have to be placed on a University restricted, password operated site, such as the Blackboard VLE.
  • Materials must only be made available to students registered on the relevant course of study, and only for the duration of the module/course.

For each digital copy there are specific obligations:

  • to append a Copyright Notice referri
  • to record and report bibliographic and course based details to CLA. This must be done by completing and returning one of the following documents to the Copyright Administrator

Due to these restrictions only designated people may place scanned material in a VLE.

Forms

We do not have scanning facilities in our department, what can I do?

We can arrange for AVS to scan the documents on your behalf, digitisation should take approximately one week, depending on the amount requested. There will be a charge for this service.

Could someone check my items for me?

TickWe can check your documents and advise which can be scanned under the CLA licence. In addition, if you wish us to, we will send a request to the rightsholder for any documents not covered.

What happens if an item is not covered by the CLA or another licence?
